Terms

These Terms govern Anistratenco websites, direct-to-user accounts, HealthOS, research, projects, voice, files, subscriptions, account balance, gifts, shared plans, and support (the “Service”). By creating an account, purchasing, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. Separate business, developer, API, beta, integration, order-form, or app-store terms apply to those offerings and control for their subject if they conflict.

You must be at least 13, or the higher minimum age required in your country. If you are under 18, a parent or legal guardian must permit your use and review these Terms. If you use the Service for an organization, you represent that you have authority to bind it. You must have legal capacity to agree, provide accurate information, protect credentials and devices, and report suspected compromise promptly.

In these Terms, “Anistratenco” means the legal service provider identified in the account, purchase, or checkout flow. That provider must be identified before a paid contract is completed. A product or trading name does not replace disclosures that mandatory law requires about the contracting entity.

Features and limits vary by plan and can include messages, context, reasoning passes, parallel tool calls, queue depth, files, file size, voice duration, shared seats, API access, metered use, and provider spend. Published plan and checkout pages state the current commercial allocation; the server enforces admission.

A maximum is a ceiling, not a promise that every request will consume it or succeed. Safety, provider availability, file compatibility, cost controls, technical limits, and abuse protection can reduce or reject work. Free currently includes up to three document imports, five image imports, and eight selected-region visual-inspection attempts per weekly period, subject to the per-message, per-file, per-turn, and format-specific analysis limits shown in the product. Paid plans may remove a fixed weekly count while retaining per-request, concurrency, storage, spend, and fair-use controls. Any metered charge must be disclosed before or when the chargeable action is admitted.

Guest chat and signed-in Free chat share one allowance of up to 15 logical messages per UTC day. A message counts when provider work begins, including when a stream is later interrupted; retries, tools, memory observation, and other auxiliary work for that same turn do not create another message unit. Browser identity continuity and adaptive human-verification controls raise the cost of automated abuse but do not prove that one browser profile is one unique biological person. Global guest capacity and security controls can pause anonymous model access independently of an individual allowance.

The current consumer Health Assistant provides informational, educational, organizational, and research assistance. In consumer mode it does not independently diagnose, prescribe, clinically monitor, or create a relationship with a doctor, therapist, pharmacist, laboratory, insurer, or other licensed professional. Do not start, stop, delay, or change professional care, medication, testing, or treatment based only on consumer-mode Service content.

A separately identified regulated clinical offering may in the future support diagnosis, prescribing, or clinical monitoring only where it is expressly available under feature-specific terms and disclosures, applicable jurisdiction and licensure requirements, clinical validation, professional oversight, informed consent, and audit controls. Product plans, prototypes, or general Service access do not mean that such an offering is currently licensed, validated, or available.

The current consumer Service is not an emergency service, cannot guarantee continuous monitoring, recognition, or a timely reply, and may only help surface relevant resources. If someone may be in immediate danger, may harm themselves or another person, has severe or rapidly worsening symptoms, or needs urgent care, contact the local emergency number or an appropriate professional immediately.

The Service uses probabilistic systems and third-party information. Outputs can be wrong, incomplete, outdated, inconsistent, unavailable, or similar to content generated for others. Models may fabricate facts or sources, extraction may omit content, tools may fail, and citations may not support every generated statement.

Independently verify outputs before health, legal, financial, safety, employment, insurance, education, eligibility, or other consequential use. Routing, critique, citation, contradiction, and safety controls reduce risk but do not eliminate error. We do not warrant a particular model, provider, source, ranking, response, or outcome.

You retain ownership of content you submit. As between you and Anistratenco, and to the extent permitted by law, you own generated output. You grant Anistratenco and its providers a limited, worldwide license to host, transmit, transform, extract, display, and process content only to deliver, secure, and support the features you request, comply with law, and enforce these Terms. The license for active content ends when it is deleted, subject to lawful retention, backups, de-identified information, and provider deletion cycles described in the Privacy Policy.

Outputs may not be unique. Other users can receive similar output, and the Service does not transfer third-party rights or guarantee that an output is protectable, non-infringing, accurate, or suitable for publication. You are responsible for reviewing output, making required disclosures, and obtaining permissions before using a person’s likeness, voice, confidential information, trademark, copyrighted work, or other protected material.

When you authorize a tool or agentic feature to search, browse, execute code, transform a file, contact a service, or take another external action, you remain responsible for the instruction, destination, permissions, review, and consequences. Preview and confirmation controls reduce accidental action but do not make an external system or result error-free.

Content processing, provider training controls, human review, moderation, feedback, and deletion are governed by the Privacy Policy and any feature-specific disclosure. We do not treat ordinary use, support, feedback, or an abuse report as interchangeable permissions. A separate affirmative choice is required where applicable law or the disclosed feature requires one.

You must have the rights, notices, permissions, and lawful basis needed for submitted content. Files can contain hidden sheets, comments, tracked changes, metadata, images, macros, or embedded objects, and processing may alter layout or omit material. Review and minimize files before upload. No regulated-data, residency, certification, data-processing, or business-associate commitment is implied without a separately signed agreement.

A paid subscription renews for the selected billing period unless canceled before renewal. You authorize the payment processor to charge the payment method on file for the price, tax, and disclosed metered charges. Prices and included use may change for a future renewal after notice required by law. Failed payment can result in retries, limited paid features, downgrade, or suspension.

The first Plus or Pro subscription purchased by a customer includes a 30-day money-back guarantee. Submit the request to hello@anistratenco.com within 30 calendar days of the initial charge. The guarantee applies once per customer and excludes renewals, account-balance deposits, gifts, separately metered usage, fraud, abuse, chargebacks, and purchases already refunded. An eligible refund ends the refunded paid access and returns funds to the original payment method; the payment provider controls when the credit appears.

Outside that guarantee, cancellation ordinarily prevents future renewal and does not undo access delivered or charges incurred. Except where checkout states otherwise or law requires a remedy, fees are non-refundable after charge, including partial periods, unused capacity, admitted metered work, and renewal not canceled in time. Mandatory cooling-off, cancellation, defective-service, and consumer rights remain intact.

Anistratenco USD balance is a closed-loop service credit tied to an account. It is not a bank account, deposit, investment, cryptocurrency, or general-purpose payment instrument; it can be used only for eligible Anistratenco purchases, has no cash-withdrawal right, and is transferable only through an authorized flow or where law requires.

Gifts are credited after confirmed payment and valid redemption. We may investigate, reject, or reverse an event affected by fraud, chargeback, error, sanctions, or unauthorized access. A shared-plan owner controls billing and invitations, not another member’s private content. Members keep separate accounts and balances.

“Unlimited” or “no fixed daily limit” does not mean unbounded compute, storage, throughput, automation, cost, or availability. Reasonable per-request, rolling, concurrency, queue, spend, safety, and abuse controls apply. Attempts to bypass limits, split abusive work across accounts, automate consumer interfaces, or exploit errors are prohibited.

API access requires an eligible plan, documented scopes, credentials, quotas, and technical controls. Keep keys secret and apply least privilege. Do not reverse engineer private endpoints, bypass admission, resell access without permission, or build an unlawful high-impact or medical-decision system. We may revoke a compromised, abusive, unpaid, or materially risky key.

• Do not violate law, sanctions, another person’s rights, or the security or privacy of any account, system, file, key, or data.
• Do not upload malware or unlawful exploitative material; facilitate fraud or serious harm; or falsely present generated content as licensed professional advice.
• Do not scrape, overload, disrupt, reverse engineer, extract non-public prompts or code, defeat billing or security controls, or train a competing service on outputs at scale without permission.
• Do not submit another person’s medical, genetic, identity, confidential, or protected content without authority.
• Do not use the Service to make a legal or similarly significant decision about another person in employment, housing, credit, insurance, education, essential services, or medical care without a lawful basis, qualified human review, notice, and any right to contest required by law.
• Do not exploit, sexualize, groom, endanger, or facilitate harm to a minor, or use the Service to promote self-harm, serious violence, regulated wrongdoing, or unlicensed professional practice.

We may remove or restrict content that allegedly infringes intellectual property or other rights and may terminate repeat infringers where required or appropriate. A report should identify the protected work or right, the material at issue, its location, the reporter’s contact information and authority, and a good-faith statement that the challenged use is not authorized. Knowingly false notices may create liability.

Send rights complaints through the contact page or to hello@anistratenco.com. We may request additional information, forward a notice or counter-notice where law permits, preserve evidence, and restore material when a valid process requires it.

Anistratenco and its licensors own the Service software, interfaces, design, branding, documentation, and provided materials. We grant a limited, revocable, non-exclusive, non-transferable right to use the Service as intended. Feedback may be used without restriction or payment unless a written agreement or law says otherwise.

The Service may use or link to independent sites, sources, processors, models, APIs, devices, or applications. Their terms and notices may apply. We are not responsible for an independent third party’s availability, accuracy, security, legality, or information handling; a link, citation, result, or integration is not an endorsement.

We may add, change, suspend, or discontinue a feature, model, provider, format, plan, or integration, with notice or a remedy where required. Preview and beta features may be incomplete and unsuitable for production or consequential use. Maintenance, incidents, capacity, provider outages, legal restrictions, and events outside reasonable control can interrupt Service.

You may stop using the Service and cancel renewal at any time. We may limit, suspend, or terminate access for security, fraud, payment failure, abuse, law, provider requirements, material breach, or risk to others. Where appropriate and required, we will provide notice and an opportunity to cure or appeal. Ownership, payment, disclaimers, liability, dispute, and lawful retention provisions survive as needed.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ANISTRATENCO AND ITS SUPPLIERS DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant uninterrupted, secure, error-free, complete, current, or universally compatible operation; preservation of data; correction of defects; or suitability for a health, professional, commercial, or safety purpose. A jurisdiction that prohibits a disclaimer limits it to the maximum lawful extent.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANISTRATENCO, ITS AFFILIATES, PERSONNEL, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFIT, REVENUE, GOODWILL, OPPORTUNITY, OR DATA; SUBSTITUTE SERVICES; OR RELIANCE ON OUTPUTS, EVEN IF ADVISED OF THE POSSIBILITY.

Their aggregate liability for all claims arising from the Service or these Terms will not exceed the greater of the amount you paid for the affected Service during the 12 months before the event or US$100. These limits do not exclude or limit fraud, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where applicable, statutory privacy or consumer remedies, or any other liability mandatory law does not allow to be excluded or limited.

A consumer may have rights and remedies that vary by location. Nothing in these Terms limits them where doing so would be unlawful. Different negotiated limits may apply to a business only under a separate signed agreement.

A business or organization using the Service will defend and indemnify Anistratenco and related parties from third-party claims and reasonable legal costs arising from its content, unlawful use, rights violations, or material breach. This applies to consumers only where lawful and based on intentional misconduct or unlawful content.

Before filing a claim, contact hello@anistratenco.com so the parties can attempt resolution; urgent relief and mandatory regulatory, consumer, or small-claims routes remain available. The governing law, forum, contracting entity, and any regional dispute procedure must be identified before contracting. Any such clause remains subject to the mandatory protections and courts available to consumers in their country of residence.

You may not use the Service where doing so would violate export-control, sanctions, or trade law. We may restrict access where reasonably necessary to comply with those rules. We may send service and legal notices electronically to the account email or within the Service; you are responsible for keeping contact details current.

These Terms, the Privacy Policy, and applicable additional terms are the entire agreement for their subject. Invalid provisions are narrowed or severed while the rest continues. A failure to enforce is not a waiver. You may not assign these Terms without consent; we may assign them with a merger, reorganization, sale, or by operation of law, subject to required notice and consumer rights. No third party is a beneficiary unless these Terms expressly say so. Provisions that by nature should survive termination do so.

We may revise these Terms for product, commercial, security, or legal reasons. A new version will show a new effective date and receive additional notice or consent where required. Changes apply prospectively unless law permits otherwise. Continued use constitutes acceptance only to the extent recognized by law.
